Terms of Service

These Terms of Service ("Terms") govern your use of realqd.com and the services offered by Q'ED LLC ("Q'd", "we", "us"). By using our website or services, you agree to these Terms.
Our services
Q'd runs waiting lines for limited releases, including products and concert tickets, offered by participating merchants. We verify participants, hold their place in line and let them know when it is their turn to buy. Purchases are made with the merchant, and the merchant's own terms apply to those purchases. The website walkthrough is illustrative: it sends no SMS, enrolls no subscribers, and collects no payments.
Fair use
Q'd exists to give real people a fair chance. You agree not to use bots, scripts, multiple identities, other people's phone numbers or any other method to gain more than one place in a line, and not to sell, transfer or share any access code we send you. We may remove anyone from a line, or refuse service, if we believe these Terms have been broken.
Waitlist
Joining our waitlist lets us contact you about early access. It does not guarantee access to Q'd or to any release.
SMS Terms
- Program. Q'ED LLC sends text messages about the releases you join: confirmation codes, updates on your place in line, notice when it is your turn and the access code you need to buy, plus replies to your requests.
- Opting in. After reviewing the release's SMS disclosure, you request Q'd text updates by texting its published keyword to its published number, or by entering your mobile number on a participating merchant's Q'd queue form and selecting the separate SMS consent box. We send the program disclosures and a one-time confirmation code. Reply with the code to confirm your request before queue admission. Sample keywords and codes in the website walkthrough do not enroll you.
- Scope of consent. SMS consent is specific to Q'ED LLC and the queue program you choose. Accepting general website terms or joining the email waitlist does not provide SMS consent. Consent to queue updates does not authorize unrelated marketing or another sender's messages.
- Frequency. Message frequency varies by release.
- Cost. Message and data rates may apply.
- Opting out. Reply STOP to any message to stop receiving Q'd texts. You may receive one message confirming your opt-out. No further messages, including turn notices and access codes, will be sent unless you opt in again.
- Help. Reply HELP for help, or email info@realqd.com.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Privacy. See our Privacy Policy. We do not sell, rent, or share mobile numbers, SMS opt-in information or messaging consent with third parties, affiliates or lead generators for marketing or promotional purposes. SMS consent cannot be transferred to another sender.
Carrier Data
You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to Q'ED LLC or its service provider for the duration of your business relationship, solely to help them identify you or your wireless device and to prevent fraud. See our Privacy Policy for how we treat your data.
Fees
Some releases may require a reservation fee to hold your place in line. Any fee, and whether it is refundable, will be shown before you pay.
Disclaimers
Our services are provided "as is". We do not guarantee that any product will be available, that you will be able to buy it, or that our services will be uninterrupted or error free. Merchants are responsible for their products, pricing, fulfillment and returns.
Limitation of liability
To the extent allowed by law, Q'd is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to our services is limited to the amount you paid us in the twelve months before the claim.
Changes
We may update these Terms. If we make material changes, we will update the effective date above. Continuing to use our services after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Kansas.
